The Times Free Press authorizes the use and sharing of the material and contents on this site through linked portal access (the “Online Services”). After accessing the Online Services, the user is authorized to view and make copies of documents, pages, images or other materials or content, for your non-commercial, personal use only. The Times Free Press reserves all other rights. You may not distribute, display, transmit or disseminate any such documents, pages, images, materials or content without the prior written consent of The Times Free Press. 3. User Account and Password


You agree that information you supply to The Times Free Press during the registration process will be accurate and complete and that you will not register under the name of, or attempt to access this site under the name of, another person. The Times Free Press reserves the right to reject or terminate any user name or account in our sole discretion. You are responsible for maintaining the confidentiality of your password for your account, and are responsible for all activity your account. You agree to notify The Times Free Press of any unauthorized use of your account. The Times Free Press is not liable for any loss or damage arising from your failure to protect your password or account information.


4. User-Provided Content


4.1 General.


You acknowledge that the Online Services include postings, messages, text, files, images, graphics, photos, audio clips, sounds, video or other materials ("User Provided Content") that have been submitted by third parties, including, without limitation, other users of the Online Services. You agree that we are a community forum and not a publisher with respect to the User Provided Content provided by third parties, and that we are not responsible for reviewing or editing any User Provided Content. Any opinions, advice, statements, services, offers or other information contained in User Provided Content are those of their respective authors or producers, and not of The Times Free Press or any of its affiliates, and we do not endorse or guarantee the accuracy of such Content.


4.2 License.


By submitting User Provided Content to the Online Services, you grant us a royalty-free, perpetual, irrevocable, nonexclusive right and license to use, copy, modify, display, archive, store, distribute, reproduce and create derivative works from the User Provided Content, in any form, media (print, electronic or otherwise), software or technology of any kind now existing or developed in the future.


4.3 Representations and Warranties.


You accept sole responsibility for all User Provided Content that you submit to, transmit through, link through, or otherwise make available through the Online Service. For all User Provided Content that you submit to the Online Service, you agree to indemnify us as provided below. By uploading or otherwise submitting any User Provided Content to the Online Services, you represent and warrant that (a) you own or otherwise have all necessary rights, including but not limited to copyrights, to the User Provided Content and have the right to use it as provided in this Agreement; (b) all information submitted by you is true, accurate, current and complete, and does not violate this Agreement; (c) you have the full right, power and authority to enter into and perform this Agreement, and have secured all third party consents, licenses, waivers and permissions necessary to enter into and perform this Agreement, including, without limitation, waivers of rights of privacy, publicity and personality from any third parties whose names, likenesses, photographs, animated portrayals, or actual or imitated voices are depicted in the User Provided Content ; (d) we shall not be required to make any payments with respect to the authorized use of any User Provided Content submitted by you, including, without limitation, any payments to you, third parties claiming through you or otherwise, publishers, rights agents, performance rights societies, persons who contributed to or whose names, likeness, photographs, animated portrayals or actual or imitated voices appear in such Content, your licensors, unions or guilds; and (e) the User Provided Content submitted by you will not (i) infringe upon or misappropriate any rights of others, including, without limitation, any copyrights, trademarks, trade secrets or other intellectual property rights, rights of publicity, rights of privacy, moral rights or any other proprietary rights of third parties, (ii) violate any applicable law, statute, ordinance or regulation, (iii) be defamatory, trade libelous, trademark disparaging, fraudulent, harassing, abusive, threatening, harmful, lewd, pornographic or obscene, (iv) disrupt, place unreasonable burdens or excessive loads on, interfere with or attempt to facilitate any unauthorized access to any portion of the Online Services, their computer systems, servers or networks; (v) transmit junk mail, chain letters, or other unsolicited bulk e-mail, spam or duplicative messages to other users of the Online Services; (vi) collect information about other users of the Online Services without their consent or otherwise systematically extract data or data fields, including, without limitation, any financial data or e-mail addresses, from the Online Services or our computer systems; or (vii) contain any viruses, trojan horses, time bombs or other programming routines or elements that detrimentally interfere with computer systems or data. You agree that, upon request, you will provide us with evidence, in a form and format reasonably acceptable to us, indicating that the User Provided Content submitted by you complies with the foregoing warranties.


4.4 Indemnity.


To the full extent permitted by law, you agree to indemnify and hold us harmless from and against any and all claims, suits, liabilities, obligations, damages, injuries, penalties, fines, losses, costs and expenses (including, without limitation, attorneys' fees) arising out of, resulting from or related to any breach of the foregoing representations and warranties. This obligation shall survive the termination of this Agreement for any reason.


4.5 Take-Down Policy.


We cannot and do not monitor all of the User Provided Content submitted through the Online Services. Additionally, we do not control, and are not responsible for, User Provided Content submitted by users. By using the Online Services, you may be exposed to content that you may find offensive, indecent, inaccurate, misleading, or otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of the Online Services and any content on the Online Service web sites, including, but not limited to, whether you should rely on such content. Notwithstanding the foregoing, you acknowledge that we shall have the right (but not the obligation) to review any User Provided Content, and to reject, delete, disable, or remove any Content that we determine, in our sole discretion, (a) does not comply with these Terms and Conditions; (b) might violate any law, infringe upon the rights of third parties, or subject us to liability for any reason; or (c) might adversely affect our public image, reputation or goodwill. Moreover, we reserve the right to reject, delete, disable, or remove any Content at any time, for the reasons set forth above, for any other reason, or for no reason.


5. Intellectual Property.


The content, trademarks, titles, characters, trade names, graphics, designs and other properties appearing on this site are protected intellectual property owned by Chattanooga Publishing Company, Inc. or its affiliates, or by third parties who have authorized use on this site. 7. RSS Feeds


7.1. Grant of License.


Subject to these terms, The Times Free Press hereby grants you a revocable, nontransferable, non-sublicensable, royalty-free, nonexclusive license to display on your website, blog or social media post the headlines, active links, or other source identifiers, and other information or materials, including any promotional taglines that you specifically select to receive through the RSS Feed provided that you do not alter, edit, or delete any of the RSS Feed. The Times Free Press may restrict, suspend or terminate your access to any aspect or all of the RSS Feed at any time, for any reason, without liability and reserves the right to modify the RSS Feed at any time within its sole discretion. The RSS Feed is protected by the copyright laws of the United States and international copyright treaties. The Times Free Press retains all rights and titles in and to the RSS Feed, and its content, and any copies or portions thereof, and any technology used to deliver the RSS Feed.


7.2. Restrictions.


Except as expressly set forth herein, or otherwise consented to in writing by The Times Free Press, you may not, directly or indirectly: (a) sell, modify, translate, copy, publish, transmit, distribute or otherwise disseminate the RSS Feed or any portion thereof; or delete or fail to display any promotional taglines included in the RSS Feed; (b) rent, lease, or otherwise transfer rights to the RSS Feed; (c) display the name, logo, trademark or other identifier on your website, blog or social media post in such a manner as to give the viewer the impression that you or the owner of the trademark, logo or other identifier is the publisher or distributor of the RSS Feed; (d) remove, conceal or obliterate any copyright or other proprietary notice or any credit-line or date-line on other mark or source identifier included on the RSS Feed, including without limitation, the size, color, location or style of The Times Free Press trademarks; (e) make any representation or warranty on behalf of The Times Free Press; or (g) use the RSS Feed on any website, blog or social media post that contains nudity or pornographic material of any kind, displays material that exploits children under the age of 18 promotes or provides instructional information about illegal activities or physical harm or injury against any group or individual, or use the RSS Feed in any manner that is obscene, defamatory, libelous, invasive of personal privacy or misleading. The Times Free Press reserves the right to terminate this license at any time.


8. Classified Advertising


The Times Free Press does not guarantee the placement of print ads online which may not be available due to technical difficulties. Any corrections or changes to a placed ad can be made by calling the classified department.


The Times Free Press reserves the right to censor, reclassify, revise edit, or reject any advertisement not meeting its standards of acceptance. We accept only standard abbreviations and require proper punctuation. Submission of an advertisement does not constitute a commitment to publish the advertisement. Publication of an advertisement does not constitute an agreement for continued publication. By placing an advertisement in The Times Free Press you agree that the advertisement as it appears in the Times Free Press will become the property of the Times Free Press and you will assign all ownership interest in the advertisement as it appears in The Times Free Press under the Copyright Act or otherwise to The Times Free Press.


The Times Free Press does not knowingly accept any advertising for real estate which is in violation of the law. The Federal Fair Housing Act provides it is it illegal to advertise "any preference, limitation, or discrimination because of race, color, religion, sex, handicap, familial status, or national origin, or intention to make any such preference, limitation, or discrimination." To complain of discrimination, contact the U.S. Department of Housing and Urban Development.


Any personal information submitted in connection with the Classified Web Order Entry shall be administered as provided in our Online Privacy Policy.


9. Fees and Payments


We reserve the right at any time to charge a fee for access to the Online Services. You agree to pay all fees and charges relating to your use and access to the Online Services.


10. Limitation of Liability/Warranties


UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL TIMESFREEPRESS.COM BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, WORK STOPPAGE, ACCURACY OF SERVICES, CONTENT OR RESULTS, COMPUTER FAILURE OR MALFUNCTION, DAMAGES RESULTING FROM DISABLING OF THE ONLINE SERVICE, RSS FEEDS OR ANY OTHER SERVICE PROVIDED BY THE TIMES FREE PRESS RELATED TO NON-PAYMENT OF LICENSE FEES, COST OF PROCUREMENT OF SUBSTITUTE GOODS, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES.
